JAMMU: Special Judge NIA Sunit Gupta on Wednesday framed charges against Nisar Ahmed Sheikh, Nisar Ahmed Butt, Azad Hussain Bagwan and Rustam Ali Bagwan, in the much publicized murder case of Anil Parihar (State Secretary, Jammu & Kashmir BJP) and his brother Ajeet Parihar in Kishtwar by terrorists belonging to banned terrorist organisation Hizbul Mujahideen (HM).
Special Judge NIA Sunit Gupta after hearing Special PP Baldev Singh for NIA whereas Advocate I H Bhat and Deepika Singh Rajawat for accused, observed that prima facie the offences under sections 302/120-B/109/34 of RPC, sections 18/19/39 of UA(P) Act are made out against accused Nisar Ahmed Sheikh, whereas, offences under sections 13/19/39 of UA(P) Act are prima facie made out against other accused namely Nisar Ahmed Butt, Azad Hussain and Rustam Ali Bagwan.
As per the case, on November 1, 2018 an information was received at Police Station Kishtwar at about 20:45 Hours, that Anil Kumar Parihar and Ajeet Kumar Parihar, sons of Laxman Dass, residents of Main Bazar Kishtwar were returning to their house after closing shop at about 20:40 Hours. When both of them reached at Tappal Gall, some unknown criminals equipped with illegal weapons, opened fired on them. Dead bodies of both were lying on the spot while assailants managed to escape from spot after the crime. In this regard, FIR No 290/ 2018 dated 1st Nov 2018 was registered at Police Station Kishtwar for offences under sections 302 RPC and section 7/27 of Arms Act. Initially, the investigation was conducted by Inspector Sameer Jillani, SHO Kishtwar. As per investigation conducted by him, the Incident was prima facie found to be a terrorist related incident and hatching of a criminal conspiracy to create terror among minority community besides destabilizing peace and tranquility of the region. When this fact of conspiracy was unearthed, the offences under sections 120-B/121 of RPC and sections 3/13/18/19 of UA(P) Act were added in case and the investigation was ordered to be carried out by a special Investigation team ( SIT) headed by ASP Kishtwar. Subsequently, in compliance to the order No. 11011/76/2018/NIA dated November 26, 2018 passed by the Ministry of Home Affairs, Govt of India, investigation was assigned to NIA who m-registered the case as RC-36 /2018/NIA/DLI for the offences under sections 302/120-B/121 of RPC, sections 7/27 of Arms Act & sections 3/13/18/19 of UA(P) Act. It Is worthwhile to mention here that during investigation, accused persons Osama-bin-Javed and Zahid Hussain were killed during an encounter with security forces on September 28, 2019 within jurisdiction of police station Batote District Ramban and in this regard, FIR No 84/2019 was registered. Similarly, the accused Haroon Abbas Wani was also killed during an encounter with security forces on January 15, 2020 at Doda. In this regard, FIR No.06/2020 was registered with Police Station Doda. As such, the proceedings against the accused persons Osama-bin-Javed, Haroon Abbas Wani and Zahid Hussain have been abated vide order dated 18.11.2020 after recording satisfaction about their deaths.
