JAMMU, June 10: The administration has almost finalized land allotment rules for landless people for construction of houses under Prime Minister’s Awas Yojana (PMAY) amid reports that the people having small piece of Government land in their possession will get the rights while others will be allotted State land including some of which was recently vacated from the possession of influential people at the nearest places.
Jammu and Kashmir has been allotted 1,99,550 houses under PMAY-G for current financial year.
Officials told the Excelsior that exercise to finalize rules and issue notification for allotment of land to landless people for construction of houses under PMAY-G is nearing completion after discussions with the Union Ministry of Home Affairs and Jammu and Kashmir Government.
“A final order will be out soon since the Government proposed to initiate process for allotment followed by construction of houses under PMAY-G for the current financial year,” they said.
They added that only point of finalization now is whether the land will be allotted on lease or given permanently to the landless people. If it will be on lease, the duration will be finalized, they said.
Under consideration, as per officials, is land around three marlas for construction of house which is considered sufficient. However, it can be increased or reduced by the Government while granting approval to the rules as there is no dearth of State land in rural areas.
“Already many poor people are in possession of some State land which is likely to be allotted to them for construction of houses if they are landless and have no land on their names. However, there will be no problem for construction of houses of those who have their own land provided that they fulfilled other conditions laid down by the Government for allotment of houses under PMAY-G,” the officials said.
Asserting that requirements of the people will be addressed while taking a final decision on allotment of Government land , they said it will be reasonable enough for construction of houses under PMAY-G, they said.
As per the officials, if the persons eligible for allotment of house under PMAY-G have no land of their own and no State land is available nearby, they will be granted land at the closest place.
The Government also proposed to utilize the land recently vacated from the influential encroachers during major anti-encroachment drive for allotment to landless people for construction of houses under PMAY-G. It may be mentioned here that the Government got vacated thousands of kanals of land from influential persons during anti-encroachment drive conducted in January and February this year.
The officials said a decision on construction of houses under PMAY-Urban will be taken when they are approved by the Union Ministry for Housing and Urban Development. The houses allotted to Jammu and Kashmir under PMAY-Grameen will be completed before March 31, 2024, the officials said.
Few days back, Lieutenant Governor Manoj Sinha had made an important announcement saying there was no law in Jammu and Kashmir to allot land to the people who don’t possess it for construction of their houses under the Prime Minister’s Awas Yojana and that the Government will shortly come out with law so that landless people get houses under the PMAY.
The administration then started an exercise to frame law and rules for allotment of Government land to the landless people to facilitate construction of houses under the Prime Minister’s Awas Yojana in both urban as well as rural areas.
During anti-encroachment drive, the Lieutenant Governor had stated that encroached land retrieved from the people will be utilized for construction of schools, hospitals and other such places of public purposes.
“The problem in Jammu and Kashmir was that some poor people who deserved houses under Prime Minister’s Awas Yojana didn’t have land on their names. Therefore, houses couldn’t be constructed for them. Further, there was no law for allotment of land to landless people for construction of houses unlike other States and Union Territories which have provision to give land to the people for raising the houses sanctioned under PMAY,” the officials said.
In view of this, they added, the Jammu and Kashmir Government had to come out with provision to allot land to the landless people before they could be sanctioned house for construction under the PMAY.
