Bail denied to two brothers involved in rape case

JAMMU: Additional Sessions Judge Udhampur S C Katal has rejected bail application two brothers, involved in rape case.
As per Police case, on February 21, 2021 a complainant/ prosecutrix submitted a written application before the Chief Judicial Magistrate Udhampur for directing SHO Police Station Udhampur to register FIR against accused persons, namely Mohd Hanief and Mohd Mushtaq, both sons of Feroz Din and two other unknown persons.
It was further mentioned that on February 6, 2021 at about 3 AM, the accused persons came from Jammu in a vehicle bearing registration No. JK14F- 9298 and forcibly entered into her room and beat complainant mercilessly. After assaulting her, the accused persons raped her. On raising hue and cry, when few villagers came to the spot and on seeing villagers, they ran away. Accordingly, FIR was registered and investigation started, during which Police recorded the statement of witnesses and prosecutrix under Section 164 of CrPC and accused were found indulged in the crime.
Additional Sessions Judge Udhampur S C Katal, after hearing APP Himanshu Parkash appearing for police, observed that under criminal law a person is presumed to be innocent unless his guilt is proved but keeping in view the nature of offence (rape) allegedly committed by petitioners, it become an exceptional case where liberty of the accused is required to be curtailed so that prosecutrix and other witnesses may not feel insecure. With these observations, Court rejected bail applications of Mohd Hanief and Mohd Mushtaq.
