Court denies bail to two accused in Arms Act case

JAMMU: The Court of Judicial Magistrate Ist Class (Sub-Judge) Jammu, Renu Dogra Gupta on Saturday rejected the bail of two accused, involved in FIR No.310/2021 of Police Station (PS) Gandhi Nagar Jammu for commission of offence under section 307 of IPC and 4/25 of Arms Act.
As per Court Order, the accused Sonu, son of Bodh Raj and Manav, son of Jeena Singh, both residents of Valmiki Colony, Gandhi Nagar Jammu approached the Court through their advocate for grant of bail. After hearing the arguments of both sides, the Court said that the basic rule may perhaps be tersely justice put as ‘bail not jail’ except when there are circumstances suggestive of fleeing from jurisdiction or thwarting the course of justice or creating other troubles in the shape of repeating offence or intimidating witnesses.
The application of the applicant cannot be considered in total isolation from the hard realities that now confront public life in the State. Personal liberty must necessarily be preserved, but certainly not in such a manner as to facilitate anti social elements. In this particular case the allegations against the accused are very serious and offence is of course very heinous in nature.

Victim is still under treatment and his statement is yet to be recorded. “The nature of offence and severity of the punishment the accused persons do not appear to be entitled for bail. It will not be in the public interest to allow the accused persons to move freely and confront with the victim day in and day out when victim is still under treatment, statements of injured and witnesses are yet to be recorded. Hence, bail application of applicants Sonu and Madav is rejected,” observed the Court.
