JAMMU: CJM Jammu Amarjeet Singh Langeh rejected bail applications of snatchers namely Balwinder Kour, wife of Kulwant Singh and Pavaneet Singh, son of Narinder Singh.
According to case, a written report was submitted at Police post Gadigarh by complainant alleging therein that while she was coming home after attending a function at Jammu in vehicle bearing registration no. JK02CQ-7859 on November 14, 2021, she stopped for purchasing bakery from Jagdev Bakery Shop Gadigarh. A Scooty without registration number driven by an unknown Sikh boy and a woman pillion rider approached from opposite side and stopped Scooty near her. Complainant further alleged that pillion rider woman snatched her purse containing a Mangalsutra, 2 golden rings and cash amounting to Rs 20,000, ATM cards and some other documents. Based on this complaint, FIR no. 263/2021 for offence under section 382 of IPC was registered at police station concerned and investigation started.
CJM Jammu Amarjeet Singh Langeh, after hearing APP Kuldeep Bhat for UT observed that while considering bail application of persons who seem to be prima facie habitual offenders, discretion to grant bail cannot be exercised in a whimsical manner and interest of society at large in such cases has also to be duly considered and taken note of (vide (2007) 1 SCC 70). In the case in hand, all factors viz nature and gravity of offence involved, character of evidence in support of allegations, punishment that the offence involved carries – which is upto ten years of imprisonment and general impact on public at large of the offence involved in the case – go poignantly against petitioners more particularly when investigation is at initial stage and subject matter of theft has not been wholly recovered. With these observations, the Court rejected bail applications.
