Court denies bail in abetment to suicide case

JAMMU: Principal Sessions Judge Samba Sonia Gupta rejected bail application of one Rakesh Kumar @ Mini, son of Girdhari Lal, resident of House No. 1039, Mast Garh, Jammu who was involved in an abetment to suicide case.
According to Police report, on January 3, 2022, information was received at Police Station Vijaypur, through PCR Samba regarding death of one Sangram Singh, son of Kawal Singh, resident of Jakh Channi, Tehsil Vijaypur, District Samba (hereinafter referred as deceased) under suspicious circumstances. Acting swiftly, inquest proceedings under section 174 of CrPC were initiated, during the course of which, statement of wife of deceased namely Sudesh Kumari was recorded, who stated that her husband was an ex-serviceman and persons namely, Jagjeevan Sharma @ Jamba, Ashwani Kumar @ Mintu, Pawan @ Foji, Rakesh Kumar @ Mini were known to him, as they are property dealers by profession and had some issues with the deceased over money. She further alleged that aforesaid persons had threatened her husband to return money; otherwise he would face dire consequences. Later, due to harassment and mental torture on part of aforesaid persons, her husband committed suicide after consuming some poisonous substance. He also wrote a ‘suicide note’, which she produced before the police. On basis of aforesaid statement of wife of deceased, FIR No. 01/2022 under sections 306/34 of IPC was registered at Police Station Vijaypur and investigation commenced, during which IO seized the inquest proceedings file, prepared seizure memo and recorded statements of witnesses under sections 161 of CrPC. Accused Jagjeevan Sharma @ Jamba surrendered before the court and on January 22, 2022, he was taken under police remand and is now on interim bail. On January 31, 2022, accused Pawan Kumar and Ashwani Kumar were also arrested, who are also on interim bail. However, accused Rakesh Kumar @ Mini is absconding from the day of commission of offence till date. From the statements of witnesses and disclosure statements made by accused, it came to fore that Rakesh used to threaten deceased to kill him in connection with payment, which was given to him through cheques as advance for a deal of property located at Kathua. Moreover, applicant was demanding Rs 60 lakh instead of Rs 40 lakh. Thereafter, accused also gave five false cheques worth Rs. 1.30 crore to deceased for betraying him in the deal. Applicant/accused visited in-laws house of deceased to pressurize and defame him. The investigation of the case is under progress and arrest of accused is crucial for further investigation of the case.
Principal Sessions Judge Samba Sonia Gupta after hearing Public Prosecutor Jawaid Ahmed Khawaja appearing for police whereas Sr. Adv MK Bhardwaj with Adv Ajay Vaid for the applicant observed that suffice is to observe that nature of gravity of accusations is severe and the accusations against the applicant are not prima facie without any basis. The role of the applicant in the alleged crime is under scanner by investigating agency, which requires the custodial interrogation. As such, this plea is not acceptable, observed Court and rejected bail plea.
