SRINAGAR, Feb 20: A local court here today directed for attaching the property of proclaimed offenders for commission of crime for Unlawful Activities Act.
Special Judge NIA court Budgam directed for attachment of property of proclaimed offenders. The accused persons Ghulam Nabi Najar alias Mudasir and Manzoor Ahmad Chopan alias Rayees were found involved in FIR 58/2024 for commission of crime under Section 7/25 of Arms Act and Sections 18, 20 and 23 of ULAP Act pertaining to Police Station Khag in district Budgam.
The public prosecutor informed the court that the commission of offences has been proved against both the accused and were earlier directed by this court through proclamation on April 26 last year to surrender before the J&K police within 30 days.
The court has further been informed that as of now both the accused have crossed the fence and are active in Pakistan occupied Kashmir and are one again ready to infiltrate into Indian Territory with ulterior motives such as attachment of both moveable and immovable property of both the accused under section 87 of CrPC.
The court after hearing the public prosecutor said that there is sufficient evidence collected by the IO against the accused for commission of crime, therefore, the onus lies on the accused to un-prove the evidence and allegation.
“This court is satisfied from the record that the accused despite being given an opportunity to appear before the court has deliberately and intentionally concealed themselves, as such this court is constrained to issue order of attachment of property”, read the order
Keeping in view of the facts of the case the Special Judge NIA Budgam directed the Collector Budgam to attach the immoveable property of both the accused in the form of land measuring 1 Kanal 16 marlas situated at Gamgulla and take the possession forthwith.
