Court denies bail to accused in stabbing case

Srinagar, Apr 18: A local court here rejected bail to a youth in Srinagar for stabbing a shopkeeper citing the investigation is at a premature stage.
The Sub-Registrar (Judicial Magistrate) Srinagar presided by Adnan Manzoor Naqashbandi denied the bail to one Arzan Rashid of Mehjoor Nagar, Srinagar in stabbing a shopkeeper with knife case.
The accused-Rashid was arrested on 01.04.2025 by Police Station Sadder on the basis of complaint with regard to stabbing a shopkeeper with a knife in the same vicinity.
The court while refusing to grant bail to the accused said the allegations against him are of a serious nature. Police have registered FIR for commission of ‘causing voluntary hurt’, ‘wrongful restraint’ and ‘attempt to murder’ against him. “These are serious offences that affect the social fabric”, the court said.
The Assistant Public Prosecutor (APP)-Safura vehemently opposed the bail application. She in her objections before the court stated that the accused person is involved in the commission of non-bailable and heinous offences as such cannot claim bail as a matter of right.
“…the medical opinion, which is crucial for a proper assessment of the case, has not yet been obtained. The incomplete status of the investigation, coupled with pending medical reports, clearly indicates that the matter requires further examination. Granting bail at this juncture would be improper, as it would prematurely disrupt the ongoing investigation and hinder the collection of critical evidence. In light of these pending aspects, the application for bail should be rejected”, APP-Safura said while advancing her arguments in the matter before the court.
The court after hearing the public prosecutor and considering the gravity of the offences, the nature of the allegations, the stage of investigation, said there is possibility of the accused tampering with the evidence or influencing the witnesses if granted bail as such the court is of the considered opinion that it is not a fit case for grant of bail.
“In view of the above, this Court is of the opinion that the factors to be considered before considering the application for bail do not favour the accused at this stage. As such, the application seeking bail of the accused is hereby rejected”, the court concluded.
