Court awards 10 yrs imprisonment in POCSO case

JAMMU, Oct 7: Principal Sessions Judge, Ganderbal Abdul Nasir has convicted and sentenced Ulfat Ahmad Magray, resident of Khanan Kangan, to 10 years of imprisonment in a case registered under FIR No. 24/2020 P/S Kangan for offences under the POCSO Act.
The case originated in April 2020 when the father of the victim, then a minor student of Class 10, lodged a complaint alleging that the accused had enticed his daughter to a forest area and committed sexual assault. Medical examination later revealed that the girl was pregnant and she subsequently gave birth to a child.
A DNA report from the Forensic Science Laboratory, Srinagar, conclusively established that the accused was the biological father of the child. The court held that the victim was a minor aged 17 years at the time of the incident, and therefore, her consent had no legal validity.
The court convicted Magray under Sections 3/4 of the POCSO Act and awarded 10 years of rigorous imprisonment along with fine, while acquitting him of the charge under Section 506 IPC (criminal intimidation) for lack of evidence.
