CCPA issues notices to eCommerce platforms for listing restricted drone, GPS Jammers

NEW DELHI, Feb 20: The Central Consumer Protection Authority (CCPA) has issued notices to six e-commerce entities for allegedly listing and selling prohibited wireless signal jammers and anti-drone equipment in violation of existing laws, an official statement said here on Friday.

The action was initiated after the CCPA took suo motu cognisance of online listings offering anti-drone systems, drone jammers and GPS jammers without mandatory statutory approvals and disclosures.

These devices interfere with wireless communication and navigation signals and are strictly regulated under the Indian Telegraph Act, 1885 and the Wireless Telegraphy Act, 1933. As per law, the use, possession, sale, purchase, import or advertisement of such jammers is prohibited, except with specific authorisation from the Central Government.

The entities that have been served notices include Everse, IndiaMart, Xboom, Javiat Aerospace, AirONE Robotics and Maveric Drones & Technologies Pvt Ltd.

The CCPA has sought detailed information from these companies, including copies of licences and approvals obtained from competent authorities, procurement and import documents, the number of units sold over the past two years, details of buyers, and the steps taken to remove such listings and prevent recurrence.

The Authority observed that failure to clearly disclose licensing requirements and regulatory restrictions may amount to misleading advertisements and unfair trade practices under the Consumer Protection Act, 2019.

It also noted that e-commerce platforms are required under the Consumer Protection (E-Commerce) Rules, 2020 to exercise due diligence and ensure that goods offered on their platforms comply with applicable laws.

The CCPA has directed the platforms to respond within the stipulated time, failing which further action may be initiated under the provisions of the Consumer Protection Act.

The move underscores the Government’s commitment to safeguarding consumer interests, ensuring compliance in the digital marketplace, and preventing the unlawful sale of sensitive equipment that may pose risks to public safety and national security. (UNI)
