JAMMU, Feb 27: The Court of Special Judge, NIA Cases, Jammu, Prem Sagar, has rejected the second regular bail application of Peer Arshad Iqbal in terror-funding case with the observation that the trial is in progress and the release of accused at this stage may hamper the course of justice by influencing witnesses yet to be examined.
The applicant is facing charges under Section 120-B IPC and Sections 17, 20, 21, 39 & 40 of the UAPA.
The allegations, as recorded in the proceedings, revolve around the applicant’s alleged role in handling multiple Cross-LoC trade firms, trading with PoK-based entities, and allegedly generating “extraordinary profits” through under-invoicing/under-declaration, which the agency claims were further channelled for unlawful activities.
The order also notes the prosecution version that funds were allegedly routed to Bashir Ahmad Sofi described as an OGW of a proscribed outfit including through a Rs 50,000 cheque dated 10.07.2013.
The court noted that this was the second bail attempt, with the first bail plea having been dismissed on 22.04.2025, and found no substantial change in circumstances warranting reconsideration.
On the progress of trial, the court recorded that charges were framed on 05.02.2024, and that 17 witnesses have been examined so far, while crucial witnesses are still pending.
Emphasising the seriousness of allegations and the likelihood of witness-influence, the court observed that if the applicant is released on bail there is every likelihood that he will influence the remaining witnesses, thereby prejudicing the trial.
