Court directs SHO Channi Himmat to book Ex Minister Harsh Dev, his wife for threatening a businessman on gunpoint and signing some papers

Sub-Judge Jammu Renu Dogra today directed register FIR against Chairman Panthers Party Harsh Dev Singh and his wife Manju Devi for threatening to one Sanjay Gandotra and signed some papers on gun point.

In the application filed by one Sanjay Gandotra through Advocate Himanshu Beotra that on 17/08/2021  at about 6:44 PM , while the complainant and his wife Shalini Gandotra were at their store at Channi Himmat in their business premises,  the Manju Devi telephonically informed   the complainant that they would be coming to the business point of complainant after which both the accused persons alongwith their PSO reached there at 07:15 PM after reaching at the store of the complainant , the accused persons asked the complainant and his wife to come out of store and made the complainant and his wife to sit in their black Scorpio Car and further made the complainant  to drive the said car in as much as the wife of the complainant was made to sit with Manju Devi alongwith their PSO at the rear seat and the Harsh Dev Singh himself sat at the front passenger seat. However after driving the vehicle to a while, the PSO of the accused persons on the direction of Harsh Dev Singh suddenly pointed his gun on the complainant  and the Harsh Dev Singh started abusing the complainant  with great rigor and further told him to sign few papers that he had brought with him .

After the atmosphere of commotion got created by the said criminal act, the Harsh Dev Singh shouted at the complainant to drive the car towards the house of the accused persons who threatened the complainants that they would be confined in the  house of the accused persons  until he would sign the papers brought by him.  While the Harsh Dev Singh was continuing with his criminal act, the Manju Devi also started abusing the complainant and his wife and threatened to eliminate them, their kids and their other family members in case the complainants would not bow to their illegal demands and even further intimidated them as to the fact that they would make sure that complainant and his childern would no longer be able to run their business.

Harsh Dev Singh further moved a step ahead and after clinching the collar of the complainant, started slapping the complainant mercilessly leading to the bruises and injury on the neck and face of the complainant. It is submitted that while the accused no. 1 was beating the complainant , the wife of complainant tried every now and then, however the accused no. 2 also started manhandling the wife of complaint and restricted her protest vis-à-vis the criminal act of the accused persons. While the continuation of the criminal acts of the accused persons with the complainant and his wife, the complainant rushed the said car  towards the concerned Police Station, sensing which the accused no. 1 started propelling his PSO to open fire at the complainant, where after complainant and his wife managed to escape from their illegal confinement near Channi police station and the accused persons ran away  in their car.

Sub-Judge Jammu Renu Dogra after hearing Adv Himanshu Beotra in length, observed that complaint      discloses      the      commission      of cognizable offences,  and directed  Incharge, Police Station, Channi Himmat, to register   case   under   relevant   sections   against   the accused u/s 156(3) Cr.P.C if not registered already.
