CBI court denies bail to SHO Loran in bribery case

JAMMU: Special Judge CBI R K Wattal rejected bail application of Station House Officer (SHO) of Loran police Station, namely Ved Prakash, who was caught red-handed while accepting Rs 10,000 as bribe from the complainant.
Special Judge CBI R K Wattal after hearing senior Adv Sunil Sethi for the applicant whereas Special PP Manmohan Sharma for CBI, while rejecting the bail application observed that in view seriousness of crime and its compulsive nature when the complainant, also a police personnel, who was not willing to give bribe is alleged to have been harassed for extraction of bribe amount from him which though not a huge amount, was still demanded by accused and accepted. Same was allegedly recovered from him in a trap laid upon him, the prima facie presumption under section 20 of PC ACT thereby proving commission of offence under Section 7 of PC ACT 1988. “With consideration that likelihood of hampering of investigation and tampering of evidence by the accused, whose statements have not been recorded particularly the departmental witnesses, the public interest is definitely not going to be served if individual right of the accused to bail is given precedence over collective interest while striking the balance of interests in the case,” with these observations, the Court rejected the bail plea.
