SRINAGAR: CJM Jammu Amarjeet Singh Langeh on Thursday directed SHO Police Station Channi Himmat, Jammu to attach moveable property of M/s Ritz Hotel, Manor, Channi Himmat, through its Managing Director to the tune of Rs. 6,34,633 (award money) and submit compliance report by or before next date of hearing. The CJM Jammu further ordered that if during execution of warrant in question it is found that respondent does not own and possess moveable property to the tune of Rs. 6,34,633, in that eventuality he should be taken into custody and produced before the Court so that further proceedings can accordingly be shaped.
The significant order has been passed in an execution filed by Rakesh Kumar & others in an award amounting to Rs. 6,34,633 (Rupees Six Lakh Thirty Four Thousand Six Hundred Thirty Three only) was passed in favour of petitioners by authority under Payment of Wages Act on 09.10.2019.
Respondent failed to deposit aforesaid award amount before the concerned authority and therefore this application invoking section 15(5) of Payment of Wages was presented in the court. CJM Jammu Amarjeet Singh Langeh while issue attachment of warrants observed that it is very sad, despite lapse of more than one year, award under execution passed under the Act as mentioned hereinabove – is yet to be fructified. An award under a pro-bono statute like payment of Wages Act if remains un-executed for more than one year, is not only contrary to the spirit of statute supra but also an utter contempt of mandate of enactment in question, the Court directed.
