HC quashes PSA of notorious criminal convicted in Bakra murder case

JAMMU: Justice M A Chowdhary quashed detention under PSA of one Rajesh Dogra @ Mohan Cheer, who was granted bail by High Court in Bakra murder case.
Justice M A Chowdhary after hearing Adv Aseem Sawhney appearing for the petition observed that dossier prepared by SSP Jammu in order of detention, almost word by word, including non-furnishing of whole record; furnishing material in English and not the language of the detenue; and not informing detenue of his right to make representation before Detaining Authority within statutory period, reflect that the Detaining Authority has not applied its mind to draw the subjective satisfaction to detain petitioner and detenue has also been deprived of his fundamental right to make effective and meaningful representation against the detention order to the Detaining Authority and the government.
For the foregoing reasons and law laid down, this petition is allowed and impugned order of detention No. 15 PSA of 2021 dated 29.11.2021 passed by the District Magistrate, Jammu, is quashed. The detenue namely Rajesh Dogra @ Mohan Cheer, son of Ved Parkash, resident of Reasi, at present House No. 797, Tali Morh, New Plot, Jammu is ordered to be released from preventive custody forthwith, provided he is not required in connection with any other case(s).
